An anti-poverty group has won its bid to take legal action against the government.
The Child Poverty Action Group claims the Working for Families package is discriminatory, as the families of a quarter of a million children don't qualify.
In a landmark case, the Human Rights Tribunal last year ruled in favour of the legal action.
The government appealed against the decision but the High Court has dismissed the challenge, paving the way for the case to proceed.
Director Janfrie Wakim says the Child Poverty Action Group is pleased with the judgement. She says all people with children should receive a weekly payment from the government.
